What subjects are included in general law for LLB and LLM students?

In general, the purpose of general law is to provide a foundational framework for understanding how legal systems function, and to provide students in the LLB/LLM programmes with an awareness not only of how to apply their legal knowledge through practical examples but also to think analytically and develop an understanding of the theoretical frameworks that underlie the application of laws.

In general, LLB/LLM students will study the following subjects as part of their general law programme:

  1. Legal methods and legal research provide the basis for understanding the analytical process of determining case law, the formation of legislation, and the process by which courts interpret the law.
  2. Contract law focuses on identifying the elements of a valid contract and describes the concepts of contract performance, obligations and remedies for non-performance
  3. Tort law provides an understanding of liability in a civil setting and covers the concept of negligence.
  4. Criminal Law explains the offences, the defences available to the accused and the types of punishments that can be imposed on those found guilty of an offence.
  5. Constitutional/Administrative Law explores the powers of the executive and legislative branches of government and the individual rights of the citizen.
  6. Jurisprudence develops critical thinking about the philosophy of the law.

For LLM students, their study of general law will generally include a greater emphasis on research, a greater use of comparative analysis of different jurisdictions, and more advanced writing ability. All of the subjects are interrelated and ultimately create a solid academic foundation for a student's future education and career in the law.

What level of legal knowledge is required to begin studying general law at university?

At the undergraduate level, many students enter university with no previous knowledge of the law. As such, most general law courses have been created in a manner where the new student will gradually become acquainted with the legal concepts being studied.

At the entry level, students are expected to have:

  • Good English language skills: Legal texts and cases require a high level of precision when being read by the reader.
  • Basic critical thinking and writing skills.
  • Willingness to structure reading and study independently.

As students advance beyond the undergraduate level, they:

  • Undergraduate students develop a basic understanding of case analysis, statutory interpretation and legal reasoning.
  • Postgraduate LLM students are generally expected to have a firm understanding of the basic legal principles, and as such, postgraduate students are expected to place a greater emphasis on research and the evaluation and application of legal principles.

The structure of general law areas is thus designed to provide support for students at all academic levels of study. Because of this, a general law course does not require the student to have received legal training at the beginning of their courses; however, it does require the student to apply a high level of commitment, to manage their time effectively and to utilise critical thinking skills as they progress through the more advanced level of their legal studies.

How does general law differ across academic levels, from foundation to LLM studies?

Throughout the progression of a student through their studies of general law, there are increasing levels of difficulty and depth. The development of the academic pathway can be divided into three distinct levels:

  1. Foundation Level: Basic legal terminology and a basic understanding of how legal systems work are provided to the student. The focus of the foundation programme is on orientation, comprehension, and academic writing.
  2. Undergraduate (LLB) Level: The main areas of study at this level are criminal law, contract law, and constitutional law; these are the three core areas of Law and have a significant impact on each other. At the undergraduate level, the student shifts from studying case law to analysing it; this shift allows them to learn how to apply legal principles through structured argument.
  3. Postgraduate (LLM) Level: The LLM programme is based on research and is typically more focused on a particular area of law or policy analysis. Postgraduate students are trained to compare and analyse multiple sources of legislation or case law to build arguments.

In all areas of study in general law, students develop the ability to read and analyse legal materials, construct and present legal arguments and apply legal principles in their academic and/or professional life. By the time they reach the LLM, students are prepared to conduct independent research and to conduct critical evaluations of legal issues.
